1 Validity of the GTC and conclusion of contract

1.1 These General Terms and Conditions (GTC) apply to purchase contracts with private customers and companies that are concluded via the provider's website.

1.2 The order is confirmed by the supplier. The contract is concluded as soon as the confirmation is received by the buyer. If the confirmation is not received within a reasonable period of time, the buyer shall regard this as a rejection of the order and shall be entitled to conclude the contract with another supplier.
These GTC also apply to purchase contracts concluded by other means, e.g. by telephone, fax or letter. Customers will be informed in the order confirmation where they can download the GTC from the Internet. If a customer does not agree with the GTC in such cases, they may exercise their right of withdrawal, see section 5.3.

2. prices and special offers

2.1 Prices are quoted in CHF. VAT and advance recycling fee as well as processing are included. Shipping costs are charged separately.

2.2 The Provider reserves the right to change prices at any time. The prices published on the website on the order date shall apply to customers.

2.3 The conditions for promotions and discounts can be found in the relevant information.

3. terms of delivery

3.1 Delivery normally takes place within 7 working days. If a longer delivery period is necessary, the customer will be informed at the latest after this period has expired. If no information is provided, the customer is entitled to waive the delivery.

4. right of withdrawal and right of rescission

4.1 Customers may withdraw from the purchase contract within 14 days without giving reasons and without penalty. The period for exercising this right begins on the day on which the goods are received by the consumer. The customer may return goods that have already been delivered at his own expense. Payments already made will be refunded by the supplier free of charge.

4.2 If a customer withdraws from the purchase due to late delivery or defects in the goods or other reasons for which the supplier is responsible, the supplier will refund any amounts already paid as well as the return costs.

5 Liability and warranty

5.1 The buyer must inspect the delivered goods as quickly as possible and report any defects immediately. The responsible customer service can be found at info@bardogs.ch . Hidden defects may still be objected to even after the goods have been put into operation or used. The making of payments shall not be deemed to be a waiver of notice of defects.

5.3 If there is a defect, the buyer has the choice of demanding rectification free of charge, making a deduction from the price corresponding to the reduced value, withdrawing from the contract or obtaining a replacement delivery. The right of the buyer to demand compensation remains reserved in all cases.

6. payment

6.1 Payment is possible in the following ways at the customer's request:

  • TWINT
  • The customer can enter their credit card number. All major credit cards are accepted. The price of the goods is booked on the day the goods are dispatched.

7 Liability for online connections

7.1 The Provider undertakes to ensure state-of-the-art security in systems, programs, etc. belonging to it and over which it has influence, and to comply with the rules of data protection.

7.2 Customers must ensure the security of the systems, programs and data within their sphere of influence. In their own interest, customers should keep passwords and user names secret from third parties.

7.3 The Provider shall not be liable for defects and disruptions for which it is not responsible, in particular not for security defects and operational failures of third-party companies with which it cooperates or on which it is dependent.

7.4 Furthermore, the Provider shall not be liable for force majeure, improper action and disregard of the risks on the part of the Customer or third parties, excessive use, unsuitable operating resources of the Customer or third parties, extreme environmental influences, interventions by the Customer or disruptions by third parties (viruses, worms, etc.) that occur despite the necessary current security precautions.

8 Application of law and place of jurisdiction

8.1 These GTC are governed by Swiss law, in particular the provisions of the Swiss Code of Obligations.

8.2 The court at the domicile of bardogs gmbh shall be responsible for any legal action brought by a customer.
