1 Validity of the GTC and conclusion of the contract
1.1 These General Terms and Conditions (GTC) apply to purchase contracts with private customers and companies concluded via the website of the Provider.
1.2 The order is confirmed by the provider. The contract is concluded as soon as the confirmation is received by the Buyer. If the confirmation is not received within a reasonable period of time, the Buyer shall consider this as a rejection of the order and shall be entitled to conclude the contract with another supplier.
For purchase contracts concluded by other means, e.g. by telephone, fax or letter, these GTC also apply. The customers are pointed out in the order confirmation where they can download the GTC on the Internet. If a customer does not agree with the GTC in such cases, he may exercise his right of withdrawal, see section 5.3.
2. prices and special offers
2.1 Prices are quoted in CHF. VAT and advance recycling fee as well as processing are included. Shipping costs will be charged extra.
2.2 The Provider reserves the right to change prices at any time. For customers, the prices published on the website on the order date apply.
2.3 The conditions for promotions and discounts are available at the relevant information.
3. delivery conditions
3.1 Delivery is normally made within 7 working days. If a longer delivery period is necessary, the customer will be informed at the latest after this period. If no information is provided, the customer is entitled to waive the delivery.
4. right of revocation and right of withdrawal
4.1 Customers may cancel the purchase contract within 14 days without giving any reason and without penalty. The period for exercising this right begins on the day the goods arrive at the consumer. The customer may return goods already delivered at his own expense. Payments already made will be refunded by the supplier free of charge.
4.2 If a Customer withdraws from the purchase due to late delivery or defects in the goods or other reasons for which the Provider is responsible, the Provider shall refund any amounts already paid as well as the return costs.
5. liability and warranty
5.1 The Buyer shall inspect the delivered goods as soon as possible and report any defects immediately. The responsible customer service can be found under info@bardogs.ch . Hidden defects can still be complained about after commissioning or use of the goods. The making of payments shall not be deemed to be a waiver of notice of defects.
5.3 If there is a defect, the purchaser shall have the choice of demanding free rectification, making a deduction from the price corresponding to the reduced value, withdrawing from the contract or obtaining a replacement delivery. The purchaser's right to claim damages shall remain reserved in all cases.
6. payment
6.1 Payment is possible in the following ways at the request of customers:

- The customer can specify the number of his credit card. All major credit cards are accepted. The price of the goods is posted on the day the goods are shipped.
7. liability for the online connections
7.1 The Provider undertakes to ensure security in accordance with the current technical state of the art in systems, programs, etc. that belong to it and over which it has influence, and to comply with the rules of data protection.
7.2 Customers shall ensure the security of the systems, programs and data within their sphere of influence. In their own interest, customers should keep passwords and user names secret from third parties.
7.3 The Provider shall not be liable for defects and malfunctions for which it is not responsible, in particular for security defects and operational failures of third-party companies with which it cooperates or on which it is dependent.
7.4 Furthermore, the Provider shall not be liable for force majeure, improper actions and disregard of risks on the part of the Customer or third parties, excessive use, unsuitable operating resources of the Customer or third parties, extreme environmental influences, interventions by the Customer or disruptions by third parties (viruses, worms, etc.) that occur despite the necessary current security precautions.
8. application of law and place of jurisdiction
8.1 These GTC shall be governed by Swiss law, namely the provisions of the Swiss Code of Obligations.
8.2 The court at the place of residence of bardogs gmbh shall be responsible for actions brought by a Customer.
